This notice updates our existing policy (16 December 2008) takes effect on 24th May 2018

This privacy notice sets out how fluentintuition ltd collects, processes and stores  any personal data information that we receive from you when you use our training services or when you use our website     www.fluentintuition.co.uk

1. INTRODUCTION

In this notice we want to clearly explain:

What learner/client data we are storing and where we’re storing it, what we do with that data, how we secure that data and who has access to it. You can contact us at any time on the contacts below regarding the information we hold as it is very important that the information we hold about you is accurate and up to date. fluentintuition ltd is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, it will only be used in accordance with this privacy notice.

2. WHAT DATA DO WE COLLECT?

Personal data means any information capable of identifying an individual. It does not include anonymised data. We may collect the following information:

A.   Personal Data - We may collect and process:

•Identity Data to  include your first name, last name, title, gender, age (we offer services to customers of 16 years and above)

•Contact Data may include your billing address, delivery address, email address and telephone numbers, Skype address and demographic information such as postcode

B.    Sensitive Data

Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data, criminal convictions and offences.

In order to provide training services and to ensure we have the correct support in place we may collect sensitive data about you to include:

  • whether you have disability or medical condition
  • whether you have a special learning difficulty
  • whether you need any specialist equipment
  • previous learning experiences, qualifications, accreditations
  • personal learning preferences

C. Transaction Data and Financial details

If you purchase training services from us we may process:

•Financial Data may include your bank account and payment card details.

•Transaction Data may include details about payments between us and other details of purchases made by you.

D. Technical information

Automated technologies or interactions: As you use our site, we may automatically collect Technical Data about your equipment, browsing actions and usage patterns. We collect this data by using cookies, server logs and similar technologies. We may also receive Technical Data about you if you visit other websites that use our cookies.

E. Other

Where we are required to collect personal data by law, or under the terms of the contract between us and you do not provide us with that data when requested, we may not be able to perform the contract (for example, to deliver goods or services to you). If you don’t provide us with the requested data, we may have to cancel a product or service you have ordered but if we do, we will notify you at the time.

We may request your opinions and comments about our services and products or potential products in the form of surveys or research.

3. HOW DO WE COLLECT DATA

We may collect data about you through a variety of different methods including:

You may provide data by filling in forms on our site (or otherwise) / brochures or by communicating with us by post, phone, email or otherwise, including when you:

•request our products/events/ services; or advice and guidance about our products/services/events

•enter a competition, prize draw, promotion or survey;

b. Indirect interactions via third parties or publicly available sources: We may receive personal data about you from various third parties and public sources as set out below:

•Technical Data from analytics provider Google based [in OR outside] the EU

•Identity and Contact Data from publicly available sources such as Companies House

•Contact, Financial and Transaction Data from providers of technical, payment and delivery services based [inside OR outside] the EU]

•Advertising networks [such as Facebook, Twitter LinkedIn and YouTube based [inside OR outside] the EU]; and search information providers [such as Google based [inside OR outside] the EU]

 

3.       WHAT DATA DO WE STORE AND FOR WHAT PURPOSE?

We will only use your personal data for a purpose it was collected for or a reasonably compatible purpose, if necessary. Should we need to use your details for an unrelated new purpose we will let you know and explain the legal reasons for processing.

We may process your personal data without your knowledge or consent where this is required or permitted by law.

We do not carry out automated decision making or any type of automated profiling.

 A. We may store personal data:

  •  To deliver the training service you have requested in person or virtually
  • To monitor and assess the quality of the services provided
  • Internal record keeping
    • For health and safety purposes for face-to-face events and live training

B. Storing financial data & Disclosure to Third Parties

  • fluentintuition Ltd does not currently store nor intend to store  financial details. These will

be utilised soley for the purpose of processing credit/debit card payment via the merchant

banking service provider PAYPAL. Your financial details will not be disclosed to third parties

other than in accordance with PAYPAL procedures.

C.  Storing transactional data & Disclosure to Third Parties Other than PayPal

  • Where required by law we will store details of transactions for legal and accounting purposes.

D. Quality improvement

We may use information you provide to monitor the quality of our services and to improve our products and services.

E. Marketing

Under the Privacy and Electronic Communications Regulations, we may send you marketing communications from us if (i) you made a purchase or asked for information from us about our goods or services or (ii) you agreed to receive marketing communications and in each case you have not since opted out of receiving such communications .

 - Which marketing communications?

We may periodically send newsletters and email update about new courses, events, services, resources, products, competitions, special offers , give-aways or other information which we think you may find interesting using the email address which you have provided.

From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information to customise the website according to your interests.

Our lawful ground of processing your personal data to send you marketing communications is either your consent or our legitimate business interests.

We will not share your personal data with any third party for their own marketing purposes without obtaining  your express consent.

4.    HOW SECURELY DO WE STORE YOUR DATA - SECURITY

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect on line, via email, by telephone or other means.

How we use cookies

Our website may contain links to enable you to visit other websites, applications or plug-ins  of interest more easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy notice. You should exercise caution and look at the privacy notice applicable to the website in question as we do not accept responsibility for the processing of data beyond our remit by 3rd party organisations. 

5.       HOW LONG DO WE RETAIN YOR DATA FOR?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for we look at its amount, nature and sensitivity, a potential risk of harm from unauthorised use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

For tax purposes, the law requires us to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years from the timer they stop being clients).

6.        DISCLOSURES OF YOUR PERSONAL DATA

We may be required to share your personal data with the parties set out below:

•Professional advisers including lawyers, bankers, auditors and insurers.

•Government bodies that require us to report processing activities.

•Service providers who provide IT and system administration services.

•Third parties to whom we sell, transfer, or merge parts of our business or our assets.

We require all third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions.

7.                 CONTROLLING YOUR DATA

If you believe that any information we are holding on you is incorrect or incomplete, please write us to or email us as soon as possible, at the below address. We will promptly correct any information found to be incorrect.

You can ask us or third parties to stop sending you marketing messages at any time by either clicking the opt-out link in the email or emailing us at Nikki.op@fluentintuiton.co.uk  at any time.

If you opt out of receiving marketing communications this opt-out does not apply to personal data provided for other transactional purposes, such as purchases, warranty registrations etc.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
